APDU_Status.ProblemIndicator is not set even though a diagnosis is reported

According to specification APDU_Status.ProblemIndicator is set when at least one diagnosis with severity "faulty" exists. 

The device sets APDU_Status.ProblemIndicator depending on the submodule state, where  only submodules in states "PNIO_SUBSTATE_SUBSTITUTE_SUBMODULE" and "PNIO_SUBSTATE_PROPER_SUBMODULE" are relevant.

In case of submodule configuration adaption, if the application uses the "Obsolte" state "PNIO_SUBSTATE_CORRECT_SUBMODULE" in Check ind response packet the device ignores these submodules while updating the APDU_Status.ProblemIndicator.
